1. Introduction

Welcome to KAARTAL (kaartal.pk), operated by KAARTAL E-commerce (Pvt.) Ltd, registered with the Securities and Exchange Commission of Pakistan (SECP). By accessing or using our multi-vendor e-commerce marketplace, you agree to comply with and be bound by these Terms and Conditions. Please read them carefully before using our platform.

Kaartal operates a digital marketplace connecting verified sellers with buyers. We facilitate transactions but do not manufacture, warehouse, or directly sell items unless explicitly marked as “Sold by Kaartal“.

2. User Eligibility

• Users must be at least 18 years old to register, buy, or sell on KAARTAL.
• Businesses and individuals must provide accurate information during registration.

3. Seller Store Use and Verification

• Sellers must register store and verify to build a trusty store . KAARTAL reserves the right to approve, reject, or suspend any store based on verification results.

Seller Verification Protocols

Individual Sellers Verification

Must submit government-issued identification:

• Computerized National Identity Card (CNIC)
• Valid Passport
• Driving License (Pakistan-issued)

Business Entities verification

Require authenticated documentation:

• SECP Incorporation Certificate
• FBR Registration Number (Active Status)
• Business Bank Account Verification

4. Security and Privacy

• KAARTAL is secured with the industry-leading WordFence security suite to protect user data and transactions.
• All personal information is handled according to our Privacy Policy and is not shared with unauthorized third parties.
• Users are responsible for maintaining the confidentiality of their account credentials.

Kaartal deploys WordFence Security Suite featuring:

• Real-time threat intelligence firewall
• Malware scanning with blockchain-backed intrusion detection
• End-to-end TLS 1.3 encryption for all data transmissions

5. Intellectual Property and Trademark

• All content, trademarks, logos, and designs on kaartal.pk are the property of KAARTAL E-commerce (Pvt.) Ltd.
• Unauthorized use, reproduction, or distribution of our trademark or copyrighted material is strictly prohibited.
• Our trademark is registered in Pakistan. Legal action will be taken against infringement.

“KAARTAL”® is a registered trademark in Pakistan. Unauthorized use triggers:

• Immediate content removal
• Legal prosecution under Trademark Ordinance 2001
• Penalties up to PKR 1,000,000

6. Listing and Selling Products

• Sellers may list physical or digital products, provided all descriptions, images, and specifications are accurate and truthful.
• All digital and physical product quality, color, and features must match the details provided in the product description.
• Sellers are responsible for ensuring their listings comply with all applicable laws and regulations in Pakistan.

Seller and Product Responsibility

• Product Quality: KAARTAL is responsible for ensuring that all products listed on our platform meet the description provided by the Seller. This includes product quality, color, and specifications.
• Transaction Responsibility: KAARTAL is responsible for processing payments for transactions conducted on our platform. If a Customer buys a product through KAARTAL and the payment is transferred via our website, KAARTAL guarantees the security of the transaction.

7. Platform Communication

• KAARTAL provides a secure platform for communication between buyers and sellers.
• All correspondence regarding orders, product inquiries, and support should be conducted through the platform’s messaging system.

8. Commission Structure

• KAARTAL charges a 5% commission on every product sold through the marketplace.
• 2% Affiliate Commission: If you promote KAARTAL’s products on another platform and a transaction is completed on KAARTAL.pk, you will receive a 2% commission on that transaction

KAARTAL Affiliate Program Terms

Requires:

• Referral traffic from approved affiliate channels
• Use of Kaartal-provided tracking codes
• Successful checkout on kaartal.pk

9. Affiliate Products

• KAARTAL is not responsible for the quality, accuracy, or delivery of affiliate products listed from other sites.
• We only guarantee transactions and product quality for purchases made directly on kaartal.pk.

10. Payment and Losses

• KAARTAL is responsible for the security of funds only when the customer purchases through kaartal.pk and payment is processed via our platform.
• We are not liable for any monetary loss if payment is made outside our platform.
• For products bought directly on kaartal.pk, we ensure the product matches the description provided by the seller.

Payment Safeguards

Kaartal acts as transactional custodian:

• Buys funds held in escrow until delivery confirmation
• Seller payments released after 3 Days buyer validation period

11. Product Quality Assurance

• KAARTAL guarantees that physical and digital products purchased through our platform will match the seller’s description regarding quality, color, and features.
• Discrepancies between the delivered product and the listed description are the responsibility of the seller, and KAARTAL will facilitate dispute resolution.

12. Site Availability

• KAARTAL strives to ensure continuous availability of the site and its services.
• However, we do not guarantee uninterrupted access and reserve the right to suspend or restrict access for maintenance, upgrades, or unforeseen circumstances.

13. User Conduct

• Users must not engage in fraudulent activities, spamming, or misuse of the platform.
• Any violation may result in account suspension or legal action.

 14. Liability Framework

Kaartal’s Responsibilities

We guarantee:

• Financial integrity for payments processed on kaartal.pk
• Product conformity to seller-provided descriptions
• Continuous platform availability (99.5% uptime SLA)

Limitation of Liability

KAARTAL is only responsible for monetary losses if the Customer buys a product directly from KAARTAL and the transaction occurs on our website. We are not responsible for losses or issues related to affiliate or external website transactions.

Kaartal is NOT liable for:

• Affiliate-linked products sold externally
• Seller misrepresentation of items
• Force majeure disruptions (e.g., internet outages, natural disasters)
• indirect, incidental, or consequential damages arising from the use of the platform.
• Our liability is strictly limited to transactions and products purchased and paid for on kaartal.pk.

Operational Policies

All transactions must use Kaartal’s:

• Encrypted messaging system
• Order management dashboard
  External communications void buyer protection

15. Amendments

• KAARTAL reserves the right to update or modify these Terms and Conditions at any time. Continued use of the platform constitutes acceptance of the revised terms.

16. Governing Law

• These Terms and Conditions are governed by the laws of Pakistan.
